All RHPPS Stallions will stand and be collected from, 'Wilsons Equine Veterinary Services', located at Southbrook on the Darling Downs just thirty kilometres south west of Toowoomba Queensland. LIVE FOAL GUARANTEE

The Breeders sole guarantee, subject to and limited by all exclusions of guarantees and warranties and subject to all limiting conditions and conditions precedent all contained herein, is the “Live Foal Guarantee”. The Breeder guarantees that the Mare Owner will through breeding either (a) obtain a newborn foal, which stands and nurses within the its first 72 hours of life, or (b) Mare Owner may return mare for breeding during the current breeding season or the following year under the terms of sect Rebreeding, in this contract. Mare Owner must pay all expenses (see sect Fees) for Boarding or Artificial Insemination (if applicable) for each re-breeding, and is subject to all terms and conditions in original contract, irrespective of a signed or verbal agreement, these are the terms advertised and the conditions of breeding..

CONDITIONS OF LFG

Mare Owner must strictly comply with all terms and conditions laid out herein. Failure to strictly comply with all terms and conditions shall void and negate LFG as of date of non-compliance by Mare Owner, without any requirement by Breeder to notify Mare Owner of such non-compliance. In addition to the conditions contained elsewhere, the following conditions must be strictly complied with.

1) If the mare miscarries the foal, the Mare Owner must provide a Veterinary Certificate, stating that the mare has miscarried the foal, and supply possible cause of why the mare miscarried.

2) If in the case of a Stillborn, the Mare Owner must provide a Veterinary Certificate and photo proof that the foal was indeed a stillborn.

3) In the case of the said foals death within the first 72 hours of life, a thorough Veterinary examination must be applied and a Veterinary Certificate must be provided, certifying that the foals death was through no fault of the Mare Owner of the Mares authorised carer, and that everything that could have been done, was done, to try and preserve the foals health and life.

4) Mare Owner must inform Breeder of the death of the newborn foal within 48 hours of death and of miscarriage within 30 days, by certified letter including a Veterinary Certificate and all other documentation required (see sect 1,2 and 3) this documentation shall be delivered to RHPPS within 14 days of whichever particular event, or the LFG is null and void. There shall be no Refund of the service fee.

If all necessary documentation can be provided, the said mare or a substitute mare may be brought back for a Return Service at no additional Service Fee (mating or booking), but all additional fees must be paid for by the Mare Owner (see sect Rebreeding).

Or

If all necessary documentation can be provided, the Mare Owner may collect full refund of the Mating Fee, this does not include the Booking Fee, Agistment, Veterinary Fees or any other Fees incurred (see sect Fees) during the mare/s stay at RHPPS. This documentation shall be delivered to RHPPS within 14 days of whichever particular event, or the LFG is null and void. There shall be no Refund of the service fee.

It is further agreed that should the above named Stallion become unfit for service or die, the LFG shall be void and negated, this contract shall be terminated without notice, and in such an event, any unused fees will be refunded to the Mare Owner. If the said specified mare becomes unfit to breed or dies, the Breeder will accept a substitute mare as a replacement, set forth in Rebreeding, which will be eligible for the LFG. Documentation shall be delivered to RHPPS within 14 days of whichever particular event, or the LFG is null and void. There shall be no Refund of the service fee.

The Mare Owner accepts and acknowledges they have no right to abort the foal without consent from RHPPS, unless RHPPS receives notifications from a Veterinarian, that the mare’s health and welfare are in jeopardy, in which case RHPPS will give unquestionable and immediate consent. In the case of the Breeders absence, a Veterinarian leaving a message on either landline or mobile is also acceptable for immediate consent. In the case of no Veterinarian notification within twelve (12) hours, that the mare’s health and welfare was threatened and required aborting the foetus to save the mare, the LFG becomes void and negated.

Unless otherwise agreed to in writing, all guarantee privileges are automatically lost and forfeited and all fees paid are forfeited if mare; is bred to any other Stallion before being bred back to Cupid, if Mare Owner fails to deliver the mare for Rebreeding the same or following season, if Mare Owner fails to notify the Breeder and supply to the Breeder a certificate stating a negative pregnancy test by a certified Veterinarian, if the mare is sold or otherwise disposed of prior to the birth of the foal or without any documentation within the required time frame as per the LFG.
